The claims against Westfield are the latest in a series of investigations that have been launched by the US Securities and Exchange Commission (SEC) into the activities of US property firms.
Westfield, a $9bn (£5.3bn) group whose City Centre division has three of Bristol’s major shopping centres, was hit with a US$50m fine in March after it was charged with fraud in connection with its 2006 acquisition of South Coast Plaza in California.
The SEC alleges that Westfield inflated its US division’s profit forecasts for 2006 and 2007 by $113m and $119m respectively, mainly by deliberately undervaluing the real estate holdings that it was selling.
The SEC also claims Westfield attempted to manipulate the performance of the Group’s retail outlets by attributing to them a higher share of revenue generated by the company’s wholesale division, which sells merchandise to other retailers. Westfield’s wholesale division accounts for about half of the company’s profits.
In a statement issued to the Stock Exchange today, Westfield said it was taking „a fresh approach to how it operates“.
